Man sues Central Park after brother hit, killed crossing street

NEW YORK (Legal Newsline) -- A man claims that his brother wrongfully died after crossing a street because of lack of proper signage. 

Wade Batten, Jr., as the administrator of the estate of Justin Batten, deceased, filed a complaint on May 19 in New York County Supreme Court against Central Park Conservancy, Inc. for wrongful death. 

According to the complaint, on May 20, 2020, Justin Batten was at the pedestrian signal located at northwest corner at the intersection of 5th Avenue and East 97th street, which was "blocked, hidden and/or not clearly visible to pedestrian crossing at that marked cross walk due to tree foliage and branches blocking the signal." 

Justin Batten went to cross when he was allegedly struck by a 2015 BMW Sedan as a result of not being able to visibly see the pedestrian sign. Wade Batten, Jr. alleges that it is the negligence of Central Park Conservancy, Inc. for not clearing the crossway allowing for the sign to be seen clearly.

Wade Batten, Jr. seeks economic, financial and pecuniary losses and expenses. Wade Batten, Jr. is represented by Carmine A. Rubino of Kramer, Dillof, Livingston and Moore.
