Lawsuit: Drunken Uber passenger commandeered car, ran pedestrian over

BOSTON (Legal Newsline) - A Revere, Mass., man is suing Uber, an Uber driver and a local Uber management company after he was struck by a rogue Uber car, a lawsuit filed in the Suffolk County Superior Court says.

The events that sparked the Feb. 8 suit began when defendant Guilherme Rocho, an Uber driver employed by Rasier, LLC, which recruits drivers for the ride-sharing program, picked up an intoxicated passenger in the late-night hours of Feb. 27, 2019. 

After the passenger started to threaten Rocho, he allegedly abandoned his vehicle with the key still in the ignition and on. The violent and drunk passenger, Matthew Tyre, then commandeered Rocho's vehicle and drove it, colliding with the plaintiff, Ricky Freni, causing serious bodily, emotional and cognitive injuries, the suit says.

Freni filed one count of negligence against Uber, Rasier and Rocher for negligence, one count of vicarious liability respondeat superior, and one count of unfair and deceptive insurance settlement practices against Uber and Rasier's insurers, James River Casualty Company, for allegedly refusing to provide and withholding information related to the suit.
