CAMDEN, N.J. (Legal Newsline) – Campbell Soup Company and Plum, PBC face a class action lawsuit over heavy metals allegedly in their baby food.
The Feb. 11 lawsuit in New Jersey federal court follows a House subcommittee report on the presence of metals in baby food. Erin Smid, the plaintiff, is represented by Jonathan Shub of the Shub Law Firm and seeks certification of a nationwide class and an Illinois class.
Campbell Soup purchased Plum, a brand of organic baby food, in 2013 for $249 million. The suit doesn’t allege harm from metals like lead and cadmium but says customers should have been told the products contained them.
“Unbeknownst to Plaintiff and members of the proposed classes, and contrary to the representations on the products’ label, the products contain toxic heavy metals, which, if disclosed to Plaintiff and members of the proposed classes prior to purchase, would have caused Plaintiff and members of the proposed classes not to purchase or consume the products,” the suit says.
“As a result, the products’ labeling is deceptive and misleading.”
