Vanilla lawyer takes on Trader Joe's over cereal

SAN FRANCISCO (Legal Newsline) – There is not enough real vanilla in cereal at Trader Joe’s for it to call it a characterizing flavor.

The lawsuit is the latest from New York lawyer Spencer Sheehan, who has filed dozens of similar cases over vanilla products. His Oct. 20 suit targets the Vanilla Almond Clusters cereal at Trader Joe’s.

“Defendant falsely and misleadingly markets the product to consumers as having a primary characterizing flavor of ‘vanilla’ that comes from vanilla beans, from the vanilla plant,” the suit says.

“In fact, the product contains non-vanilla, artificial flavors not disclosed to consumers and has a de minimis vanilla.”

The lawsuit is a proposed class action.
