CVS's hand-sanitizer doesn't deliver on claims, lawsuit says

LOS ANGELES (Legal Newsline) – CVS is accused of selling hand-sanitizer that fails to live up to the claim that it kills 99.99% of germs.

Plaintiff Joseph Mier and his lawyers at Wilshire Law Firm filed a class action lawsuit recently in Orange County Superior Court in California. CVS on Oct. 13 removed the case to Los Angeles federal court.

“These statements, in that they are made with a degree of certainty to the hundredth digit, necessarily imply that a scientific study proves that the product in fact kills 99.99% of germs,” the lawsuit says.

“Accordingly, they are each false statements, as no scientific study supports them.”

It is “scientifically proven” that alcohol-based hand-sanitizer can’t kill that many types of germs, including norovirus, the suit says.

“It is hard to believe that Defendant’s hand-sanitizer kills 99.99% of all germs, while excluding the family of viruses that causes more than half of all food-borne illnesses in the country,” the suit says.
