Lawsuit: Six Flags is closed for coronavirus but keeps charging season pass members

LOS ANGELES (Legal Newsline) —  A Los Angeles woman has filed a class action against Six Flags, alleging park members and season pass holders are being billed despite parks closing during the COVID-19 outbreak. 

Francis Ruiz, individually and on behalf of all others similarly situated, filed a complaint April 13 in the U.S. District Court for the Central District of California against Magic Mountain LLC Six Flags Theme Parks Inc. and Six Flags Entertainment Corp. alleging violation of the California's Consumer Legal Remedies Act and other claims. 

Ruiz began a monthly membership to Six Flags in 2019 and pays $9.95 per month to access the defendants' parks. The plaintiff alleges that Six Flags continues to charge members and season pass holders membership fees despite the parks closing on March 13 due to the COVID-19 outbreak. Ruiz claims the defendants refuse to refund paid members for the time they were not able to access the parks and has only offered "extended passes."

Ruiz seeks monetary relief, trial by jury, interest and all other just relief. She is represented by Yeremey Krivoshey and Frederick Klorczyk III of Bursor & Fisher in Walnut Creek, California.
