Champion Foods alleges New York law firm, partner illegally released escrow funds

NEW YORK (Legal Newsline) — A New York law firm and one of its partners are facing a lawsuit from Champion Foods alleging it released escrow funds in violation of a sales agreement. 

Champion Foods Inc., filed a complaint April 13 in the U.S. District Court for the Southern District of New York against Eaton & Van Winkle (EVW) LLP and Robert Katz alleging breach of contract and breach of fiduciary duty.

According to the complaint, Katz and his firm EVW represented A&J Global Corporation in negotiations with Danex International and Champion in 2016 regarding Champion supplying 25,000 metric tons of sugar to Danex and A&J. 

An agreement between the parties included $200,000 in escrowed funds. Champion alleges the defendants released the funds without the conditions that were laid out in the agreement being met. 

Champion seeks monetary relief, trial by jury and all other just relief. They are represented by Barry Bordetsky of The Law Offices of Barry M. Bordetsky in New York.
