NEW YORK (Legal Newsline) – A New York woman is suing Waste Management, alleging that she was unfairly charged to receive paper statements.
Julianne Heigl, individually and on behalf of all others similarly situated, filed a complaint in the U.S District Court for the Eastern District of New York against Waste Management of New York LLC and Waste Management Inc. alleging deceptive acts or practices.
The plaintiff alleges up until at least September, the defendants charged a $6.50 administrative charge fee for customers to receive a paper billing statement in the mail. The plaintiff alleges that this practice is prohibited by New York law and that she has been charged this fee since she became a customer 10 years ago.
The plaintiff is seeking trial by jury, compensatory damages, attorneys' fees, interest, court costs and just relief. The plaintiff is represented by Philip L. Fraietta and Frederick J. Klorczyk III of Bursor & Fisher P.A. in New York City and Walnut Creek, California.
