Employee alleges Bimbo Bakeries failed to pay overtime

BIRMINGHAM — A Madison County man is suing a bakery, alleging he was not paid for overtime work. 

Kenneth Cox, individually and on behalf of all others similarly situated, filed a class action complaint April 15 in U.S. District Court Northern District of Alabama against Bimbo Bakeries USA Inc., and Bimbo Foods Bakeries Distribution LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Cox was regularly paid below what he was owed. The suit states he was employed by Bimbo Bakeries and, as a condition of employment, he signed a distribution agreement with the defendant. 

The suit alleges Cox regularly worked in excess of 40 hours a week but that Biombo's compensation was not appropriate for the hours worked and pay requirements for overtime hours worked as required by FLSA.

Cox seeks trial by jury, declaration of violation of FLSA, wages and overtime due, statutory, compensatory, punitive and liquidated damages, interest, attorney fees, court costs and all other just and proper relief.
