BUFFALO — New York state has reached a settlement with a Buffalo-area developer who allegedly failed to disclose leaking and corroding water pipes to buyers purchasing condos.
According to the New York Attorney General's Office, Fisher Homes LLC and its principal Peter Hunt knowingly sold condos with leaking pipes to buyers at its Fisher Pond condominium development in Williamsville, New York.
“Developers are legally obligated to disclose key facts, such as leaking and corroding pipes, so that buyers can make an informed decision,” New York Attorney General Barbara Underwood said in a statement. “My office will continue to hold developers accountable to ensure New Yorkers have the transparency and information they deserve when buying a home.”
“We are grateful to the Attorney General’s Office for helping secure funding to correct our waterline issue,” said Fisher Pond Condo Association president Michael Peters. “The office listened to our issue, provided status updates and prioritized the consumer every step of the way. I hope home builders, developers and real estate firms take notice. There will be consequences for those that don’t do right by the consumer and violate the law.”
The settlement includes Fisher Pond and Hunt paying the Fisher Pond Condo Association $104,300 for pipe replacement and reimbursement, according to Underwood's office.
