Mott’s Fruit Flavored Snacks have artificial flavoring, consumer alleges

SANTA ANA, Calif. (Legal Newsline) – A California consumer alleges Mott's Fruit Flavored Snacks labels do not disclose that the products contain artificial flavoring.

Adrienne Morris filed a complaint on behalf of all others similarly situated on Oct. 4 in the U.S. District Court for the Central District of California against Mott’s LLP alleging fraud by omission, negligent misrepresentation and other counts.

According to the complaint, the defendant manufactures a variety of Mott's Fruit Flavored Snacks. The plaintiff alleges "The products are labeled as if they are flavored only with natural ingredients when it in fact they contain an undisclosed artificial flavor, malic acid, in violation of state and federal law," according to the suit.

The plaintiff holds Mott’s LLP responsible because the defendant allegedly did disclose the existence of artificial flavoring on the front label of the snack products as required by law.

The plaintiff requests a trial by jury and seeks disgorgement, restitution, punitive damages, prejudgment and post-judgment interest, attorneys' fees and costs and other and further relief as the court may deem just and proper.
