NEWARK, N.J. (Legal Newsline) – A New Jersey contract manufacturing and packaging service company alleges a client has interfered with contractual relations.
Cosmetic Perfume Filling & Packaging Inc. filed a complaint on July 23 in the U.S. District Court for the District of New Jersey against Le Papillon LTD, AKI Inc. and Bioplan USA Inc., all doing business as Arcade Beauty, alleging breach of contract, misappropriate of trade secrets and other counts.
According to the complaint, the plaintiff and Le Papillon entered into a services agreement in 2013, which contained noncompete and nonsolicitation provisions.
The plaintiff alleges that Arcade representatives have "made misrepresentations and spread falsehoods to customers" that the plaintiff is owned by or is a subsidiary of Le Papillon and/or Arcade and is diverting the plaintiff's customers away. The plaintiff also alleges Arcade reps are falsely claiming that the plaintiff is causing delays in filling and packaging Arcade Beauty products.
The plaintiff requests a trial by jury and seeks judgment against defendants, injunctive relief, award all profits and damages, attorneys’ fees, interest and further relief as the court may deem just.
