Florida's Natural Orange juice falsely advertised as natural, consumer alleges

Lawsuits

BROOKLYN, N.Y. (Legal Newsline) – A consumer alleges a brand of orange juice is not natural as advertised and contains a synthetic biocide used to kill weeds.

Alexandra Axon, on behalf of herself and all others similarly situated, filed a complaint on July 20 in the U.S. District Court for the Eastern District of New York against Citrus World Inc. and Florida's Natural Growers Inc. for allege violation of the New York general business laws.

According to the complaint, Axon purchased Florida's Natural Orange Juice as she and other similarly situated class of consumers relied on defendants' statement that the products are "natural" and a paid premium price for the products.

However, Axon claims the statements are false because the products are not natural as they are highly processed and allegedly contain glyphosate, a synthetic biocide frequently used to kill weeds.

The plaintiff holds Citrus World Inc. and Florida's Natural Growers Inc. responsible because the products do not conform to the affirmations that they are natural.

The plaintiff requests a trial by jury and seeks award for damages, pre- and post-judgment interest, order of restitution, declaratory and injunctive relief, costs of suit, and such other and further relief as the court deems just and proper. She is represented by Kim E. Richman of Richman Law Group in Brooklyn, New York; and D. Greg Blankinship and Todd S. Garber of Finkelstein, Blankinship, Frei-Pearson & Garber in White Plains, New York.
