LOS ANGELES – A Whittier, California man and customer of a pet supplies store alleges the store failed to respond to his request for information.
David Gamez filed a complaint individually and on behalf of all others similarly situated on June 21 in the U.S. District Court for the Central District of California against Petco Animal Supplies Stores Inc., doing business as Doctors Foster and Smith, and Does 1-10 alleging violation of California's Shine the Light Law (STLL).
According to the complaint, the plaintiff made a request May 15 to the defendants under the STLL to inquire whether they had and to what extent they used his personal information during the preceding calendar year.
"The STLL requires certain businesses to inform consumers, upon written request, whether and to what extent a business has utilized or shared a consumer’s 'personal information' within the last year," the suit states.
He alleges the defendants have failed to provide the information he requested.
The plaintiffs hold Petco Animal Supplies Stores and Does 1-10 responsible because the defendants allegedly injured him by failing to provide the requested information.
The plaintiff seeks judgment against the defendants, certify class action, injunctive relief, award of statutory damages of $3,000 per class member, punitive damages, interest, attorneys’ fees, expenses and costs of suit, and further relief as the court deems just.
