Customer alleges Ulta Beauty resells used products as new

MIAMI (Legal Newsline) – A Florida woman alleges a beauty store chain unlawfully resells partially used products.

Lianne Yao filed a complaint on April 30 in the Circuit Court of the 11th Judicial Circuit in and for Miami-Dade against Ulta Beauty Inc. and Ulta Beauty Cosmetics LLC alleging violation of the Florida Deceptive and Unfair Trade Practices Act.

According to the complaint, the plaintiff alleges that the defendants resell partially used beauty products that have been returned to its stores. The plaintiff alleges she is a regular customer and purchased products at the defendant's Miami retail locations believing she was purchasing new products. She alleges had she known of the defendant's alleged practice, she would not have purchased products from it.

The plaintiff holds Ulta Beauty Inc and Ulta Beauty Cosmetics LLC responsible because the defendants allegedly misrepresented used beauty products as new and unused.

The plaintiff requests a trial by jury and seeks an award for attorneys' fees and costs under FDUTPA and other relief as the court deems just and appropriate. She is represented by Lance A. Harke, Daniel Tropin and Barbara C. Lewis of Harke Clasby & Bushman LLP in Miami Shores, Florida.
