EEOC: Happy Jack's Casino revoked job offer after applicant tested positive for prescribed medication

SIOUX FALLS, S.D. (Legal Newsline) — The U.S. Equal Employment Opportunity Commission (EEOC) announced May 18 that M.G. Oil Company, which does business as Happy Jack’s Casino, will pay $45,000 after allegations of disability discrimination.

According to allegations, an applicant to M.G. Oil had his offer of employment revoked after a drug test showed a certain drug that had been legally prescribed to the applicant.

"During an investigation of a single applicant who was not hired, the EEOC reviewed M.G. Oil's policies, found a new ADA violation, and now a companywide change will be made that will benefit over one thousand employees," said Julianne Bowman, the EEOC's district director in Chicago in a statement. Bowman handled the case for EEOC prior to the lawsuit. 

“Employers must follow the law and take steps to ensure that their third-party vendors and independent contractors do the same,” added Greg Gochanour, the regional attorney for the EEOC's Chicago District, in a statement.

EEOC's Chicago District Office oversees agency operations in Illinois, Wisconsin, Minnesota, Iowa and North and South Dakota, with Area Offices in Milwaukee and Minneapolis.
