Consumer claims Fitness International misleads customers into signing yearlong memberships

LOS ANGELES (Legal Newsline) – A Florida woman alleges she was misled into purchasing a yearlong gym membership.

Lori Rocca filed a complaint on behalf of other members of the general public similarly situated on Jan. 15 in the U.S. District Court for the Central District of California against Fitness International LLC and Does 1-10 alleging violation of the California False Advertising Law, Unfair Competition Law and the Florida Deceptive and Unfair Trade Practices Act.

According to the complaint, "Defendants pressured consumers into signing agreements for yearlong gym memberships by misleading consumers into believing that they were only obtaining and obligated to pay for one month membership."

The plaintiff alleges she purchased the defendant's services at its South Tampa, Florida location and that the sales representative informed her that she could cancel the membership and only be charged for one month. She alleges that when she tried to cancel it, she was informed that she had signed an agreement for a one-year membership and was charged for additional months on her credit card.

The plaintiff holds Fitness International LLC and Does 1-10 responsible because the defendants allegedly provided misleading advertisements and listed false pricing information.

The plaintiff requests a trial by jury and seeks injunctive and declaratory relief, restitution or actual damages, treble damages, interest, punitive damages, court costs and any further relief the court grants.
