Groups claim EPA Administrator Pruitt failed to meet deadline regarding ozone standards

SAN FRANCISCO (Legal Newsline) – Several groups have filed suit against the administrator of the U.S. Environmental Protection Agency over allegations that a deadline to name areas that are in compliant or not regarding ozone standards has passed.

American Lung Association, American Public Health Association, American Thoracic Society, et al. filed a complaint on Dec. 4 in the U.S. District Court for the Northern District of California against U.S. Environmental Protection Agency Administrator Scott Pruitt for alleged violation of Clean Air Act.

According to the complaint, the plaintiffs allege that the defendant has failed to promulgate the designations of areas of the country that meet or do not meet the 2015 National Ambient Air Quality Standards for the ozone. They allege the signing of a rule in October 2015 mandated that this be completed by Oct. 1, 2017. 

The plaintiffs allege that the failure to meet the deadline violates the Clean Air Act.

The plaintiffs seek to enjoin the defendant from violating his nondiscretionary duty, order of area designations, award of costs of action and grant such other relief as the court deem just and proper. They are represented by Paul R. Cort of Earthjustice in San Francisco.
