Consumer claims Yogi Green Tea Kombucha doesn't contain kombucha

SAN DIEGO (Legal Newsline) – A California woman alleges she was misled by the deceptive marketing of a brand of tea.

Sydney Cohen, individually and on behalf of herself and all others similarly situated, filed a complaint on Nov. 17 in the U.S. District Court for the Southern District of California against East West Tea Co. LLC and Does 1-50 alleging violation of False Advertising Law and Consumers Legal Remedies Act.

According to the complaint, the plaintiff alleges that in October 2015, she purchased defendant's Yogi Green Tea Kombucha tea bags based on the claim the product contained organic kombucha.

However, plaintiff alleges the advertising and marketing campaign of the product was false, deceptive and misleading because defendant's product does not contain any organic kombucha in its tea bags. 

The plaintiff alleges that she relied on this misrepresentation when she purchased the product and has been damaged.

The plaintiff requests a trial by jury and seeks award of monetary and punitive damages, declaratory and injunctive relief, costs and expenses and such further relief as may be just and proper. She is represented by Brittany C. Casola of Carlson Lynch Sweet Kilpela & Carpenter LLP in San Diego.
