Consumer claims Merchants' Credit Guide Co. collection letter failed to identify creditor

TRENTON, N.J. (Legal Newsline) – An Atlantic City, N.J., woman alleges a debt collector sent her a letter that violated federal collection laws.

Tashee Reid, individually and on behalf of all others similarly situated, filed a complaint on Oct. 26 in the U.S. District Court for the District of New Jersey against Merchants' Credit Guide Co. for alleged violation of Fair Debt Collections Practices Act.

According to the complaint, the defendant sent the plaintiff a collection letter for an alleged debt on July 7. The plaintiff claims the letter did not contain all the requirements needed for collection purposes as the law requires, including the identity of the current creditor. 

The plaintiff holds Merchants' Credit Guide Co. responsible because the defendant allegedly failed to clearly and explicitly identify and name the creditor to whom the debt is owed and failed to indicate the relationship between the party who referred the account to the debt collector and if the referral is from the creditor or another party.

The plaintiff requests a trial by jury and seeks statutory damages, actual damages, costs, attorneys' fees, expenses, pre- and post-judgment interest, and further relief as the court may deem just and proper. She is represented by Yaakov Saks of RC Law Group PLLC in Hackensack, New Jersey.
