LOS ANGELES (Legal Newsline) – A California man claims that Starbucks Doubleshot beverages do not contain two shots of espresso based on the drink's caffeine content.
Oliver Naimi filed a complaint on behalf of himself and all others similarly situated on Sept. 1 in the U.S. District Court for the Central District of California against Starbucks Corp., Starbucks New Venture Co., Pepsico Inc, and North American Coffee Partnership alleging common law fraud and violations of California civil codes.
According to the complaint, the plaintiff reasonably relied on the defendants' description of the Doubleshot drink as having two shots of espresso when it does not. The suit states that the Starbucks website lists two shots of espresso as having approximately 150 milligrams of caffeine, while the Doubleshot drinks have 110 milligrams or less.
He alleges he would not have purchased the product or would have paid less had he known this.
The plaintiff requests a trial by jury and seeks damages, interest, restitution, injunctive relief, all legal fees and any other relief as the court deems just. He is represented by Benjamin Heikalai of Faruqi & Faruqi LLP in Los Angeles.
