Spanish speaker alleges Solarcity Corp. did not provide translation of contract

LOS ANGELES (Legal Newsline) – A California woman alleges a solar company misrepresented its goods and that she has not received the energy savings promised to her.

Armida Guzman filed a complaint on behalf of herself and all others similarly situated on Sept. 4 in the U.S. District Court for the Central District of California against Solarcity Corp. alleging violation of California civil and business and professional codes.

According to the complaint, the plaintiff solely speaks in Spanish and a representative of the defendant came to her residence in April 2015 to solicit solar panels. She alleges the negotiation was conducted in Spanish and that the representative told her that her energy bill would decrease if the defendant installed solar panels. 

The suit states the plaintiff was required to sign a contract written in English and was not provided a translation. She alleges she has not experienced the energy savings promised.

The plaintiff requests a trial by jury and seeks injunctive relief, restitution, disgorgement, all legal fees and any other relief as this court deems just. She is represented by Abbas Kazerounian and Matthew M. Loker of Kazerouni Law Group, APC in Arroyo Grande, California and Joshua B. Swigart of Hyde & Swigart in San Diego.
