Sirius XM alleged to have collected information without consent for solicitation

LOS ANGELES (Legal Newsline) – A California consumer claims that Sirius XM uses personal information from motor vehicle records for solicitation purposes.

James E. Andrews filed a complaint on behalf of all persons similarly situated on Aug. 24 in the U.S. District Court for the Central District of California against Sirius XM Radio Inc. and Does 1 through 100 citing the Driver Privacy Protection Act.

According to the complaint, the plaintiff purchased a car in January that previously had a Sirius XM radio account. He alleges he received eight notices from the defendant from January to August to solicit him into purchasing services. He alleges he has never had a Sirius XM account.

The plaintiff holds Sirius XM Radio Inc. and Does 1 through 100 responsible because the defendants allegedly collected personal information from the plaintiff without his consent and used those information to send advertisements and offers.

The plaintiff seeks injunctive relief, compensatory damages, punitive damages, interest, all legal fees and any other relief as this court deems just. He is represented by Jeffrey Wilens of Lakeshore Law Center in Yorba Linda, California and Jeffrey P. Spencer of The Spencer Law Firm in San Clemente, California.
