Man claims A Place for Mom did not have his permission to call him

CHICAGO (Legal Newsline) – An Illinois man claims that the largest senior living referral service in the country unlawfully called him.

Andrew Kim filed a complaint on behalf of all others similarly situated on Aug. 7 in the U.S. District Court for the Northern District of Illinois, Eastern Division against A Place for Mom Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the defendant calls consumers who are looking for senior care and then refers consumers to its customers for a fee. The plaintiff claims that he visited the defendant's website in July and provided personal information to begin a search. He alleges that immediately after clicking "search," he received an automated telemarketing call from the defendant. He alleges that he was not aware he would be receiving calls by using the defendant's website.

The plaintiff holds A Place for Mom Inc. responsible because the defendant allegedly invaded his privacy and called him without his prior express consent.

The plaintiff seeks injunctive relief, treble damages of up to $1,500, statutory damages of $500, all legal fees and any other relief as the court deems just. He is represented by Gary M. Klinger and Ryan F. Sullivan of Kozonis Law LTD in Chicago.
