Man alleges Barclays Center denied employment because of misdemeanor in background check, files class action

NEW YORK (Legal Newsline) – A New York man alleges he was unlawfully denied employment because of the results of a background screening.

Lloyd Brooks filed a complaint on behalf of himself and others similarly situated on July 14 in the U.S. District Court for the Eastern District of New York against Brooklyn Events Center LLC, doing business as Barclays Center; Brooklyn Sports & Entertainment; Anschutz Entertainment Group Inc.; and AEG Management Brooklyn LLC citing the New York State Human Rights Law and other counts.

According to the complaint, the plaintiff alleges that he applied and was given a conditional offer of employment as a facilities conversation crew member at Barclays Center in 2015. He alleges his employment was later denied because of a 2011 misdemeanor reported on a standardized commercial background screen the defendants obtained from Nationwide Screening Services.

The plaintiff holds Brooklyn Events Center LLC, doing business as Barclays Center; Brooklyn Sports & Entertainment; Anschutz Entertainment Group Inc.; and AEG Management Brooklyn LLC responsible because the defendants allegedly discriminated plaintiff by rejecting his employment when they found out that he had a past criminal conviction and did not perform the requisite analysis as required by the New York State Human Rights Law.

The plaintiff requests a trial by jury and seeks actual and punitive damages, injunctive and declaratory damages, interest, all legal fees and any other relief as the court deems just. He is represented by Monica Welby and Sally Friedman of Legal Action Center in New York City.
