SAN FRANCISCO (Legal Newsline) – A Texas consumer has filed a lawsuit against the makers of Nature's Recipe pet food over allegations that the products are falsely and deceptively labeled as all natural.
Nancy Van Mourik filed a complaint on behalf of all others similarly situated on July 10 in the U.S. District Court for the Northern District of California against Big Heart Pet Brands Inc. alleging violation of California commercial codes, common law fraud, intentional misrepresentation and other counts.
According to the complaint, the plaintiff alleges that she paid a premium price for Nature's Recipe Adult Healthy Weight food and would not have purchased or paid significantly less for it had she known the "all natural" wording on the label was false and misleading.
The plaintiff holds Big Heart Pet Brands Inc. responsible because the defendant allegedly knew that its product contains non-natural, artificial and synthetic ingredients such as sodium tripolyphosphate and citric acid.
The plaintiff requests a trial by jury and seeks all damages, interest, restitution, monetary relief, attorneys' fees, and other such relief as the court deems just and proper. She is represented by Barbara A. Rohr and Benjamin Heikali of Faruqi & Faruqi LLP in Los Angeles.
