Labor Department alleges Florida business guilty of profit-sharing plan embezzlement

JACKSONVILLE, Fla. (Legal Newsline) — The U.S. Department of Labor announced June 19 that the Secretary of Labor has filed a complaint against Andrea Lynn McCarthy, Lisa Hall, Truss Systems LLC and Truss Systems LLC Profit Sharing Plan.

According to allegations, McCarthy embezzled $111,624 from the Truss Systems profit sharing plan between Jan. 28-June 6, 2009. McCarthy and Hall, who was held jointly liable, are permanently banned from acting as a fiduciary, trustee, agent or representative for employee benefit plans as defined by the Employee Retirement Income Security Act of 1974, in the future. They have been ordered to pay restitution plus an additional $25,253 in interest lost earnings.

The U.S. District Court for the Middle District of Florida Jacksonville Division, appointed AMI Benefit Plan Administrators Inc. to terminate the plan, collect and administer the plan’s assets and make distributions to the affected participants.
