Environmental groups sue Army Corps of Engineers over Chattohoochee issues

WASHINGTON (Legal Newsline) — Environmental groups are suing the the U,S. government, alleging violation of federal law.

The National Wildlife Federation, Florida Wildlife Federation and Apalachicola Bay and River Keeper, Inc. filed a complaint on April 27 in U.S. District Court for the District of Columbia against the U.S. Army Corps of Engineers, assistant army secretary Douglas W. Lamont, Todd T. Semonite and  C. David Turner, alleging they caused significant damage and harm to the Chattohoochee River in Georgia and Alabama.

According to the complaint, the plaintiffs were damaged on behalf of the public, which will be impacted by the damages that will be done to the river basin. The plaintiffs allege the defendants failed to comply with federal law with regards to their operation of federal dams and reservoirs along the Chattohoochee River.

The plaintiffs seek declaration the defendants have violated the National Endowment Policy Act, a declaratory judgment,injunction against the defendants, injunction against the implementation of the updated Water Control Manual until the corps properly evaluates the impacts of its action, attorney fees, plus all other relief the court deems just and proper. They are represented by attorney Tania Galloni of Earthjustice in Miami.
