Women say certain L’Oreal, Matrix Essentials products don't contain keratin as advertised

NEW YORK (Legal Newsline) — Two consumers have filed a class-action lawsuit against L’Oreal USA, Inc. and Matrix Essentials, LLC, citing alleged false, deceptive and misleading advertising.

Brandi Price and Christine Chadwick, individually and on behalf of all others similarly situated filed a complaint on Jan. 26, in the U.S. District Court for the Southern District of New York against the defendants alleging that they violated the Federal Food, Drug and Cosmetics Act.

According to the complaint, the plaintiffs allege that in 2016 they purchased Keratindose products from L’Oreal USA and Matrix Essentials for personal use. As a result of the defendants' misrepresentations, the plaintiffs were damaged for buying products that are worthless or less valuable. Chadwick suffered hair loss after using the products, the complaint states. The plaintiffs hold L’Oreal USA and Matrix Essentials responsible because the defendants allegedly claimed that their products contained keratin treatments that repair damaged hair. The products do not contain any keratin, according to the complaint.

The plaintiffs request a trial by jury and seek declaration that this action is properly maintained as a class action, appointing plaintiffs as class representatives and their counsels as class counsels, award for actual and statutory damages, litigation costs and such other relief that are just and proper.
