Orange County man says Express overcharges for shipping

NEW YORK (Legal Newsline)  — An Orange County, California, man has filed a class-action lawsuit against Express, LLC and Does 1-10, citing alleged fraudulent and/or deceptive practices.

Jim Reider filed a complaint on Jan. 23 in the U.S. District Court for the Central District of California against the clothing company, alleging that it violated the Unfair Competition Law and the Consumers Legal Remedies Act.

According to the complaint, Reider alleges that he purchased a small, lightweight product from Express, for which he was charged $17.93 plus tax and $8 for shipping and handling. Reider holds Express and Does 1-10 responsible because the defendants allegedly unreasonably charged shipping and handling fees that are in excess of the actual cost of shipping the product.

Reider requests a trial by jury and seeks an order for certification of the putative class, award for compensatory damages, attorneys’ fees and costs and all other relief as the court may deem appropriate. He is represented by Scott J. Ferrell and Victoria C. Knowles of Pacific Trial Attorneys, APC in Newport Beach.
