PlayStation 4 owner accuses Sony of selling a defective product

SAN FRANCISCO (Legal Newsline) — A PlayStation 4 owner has filed a class action lawsuit against Sony, citing alleged fraudulent business practices.

Dominic Moschitti filed a complaint on behalf of all others similarly situated on Oct. 26, in the U.S. District Court for the Northern District of California against Sony alleging it violated the Magnuson-Moss Warranty Act and California’s Song-Beverly Consumer Warranty Act.

According to the complaint, the plaintiff alleges that he suffered an ascertainable loss of money for paying a premium price for a defective product and for the monetary costs associated with attempting to repair the defect. The plaintiff holds Sony responsible because the defendants allegedly refused to replace the defective PlayStation and offered to repair it at a cost of approximately $149.

The plaintiff requests a trial by jury and seeks an order for this claim to proceed as a class action, appointing plaintiff and his counsel as class representatives, award for all damages, pre- and post-judgment interest, attorneys’ fees and cost and such further relief as the court deems appropriate.
