LOS ANGELES (Legal Newsline) — A California man is suing a college matching service, alleging violation of telephone harassment statutes.
Dave Alan filed a class action complaint, individually and on behalf of all others similarly situated, Oct. 17, in U.S. District Court for the Central District of California against Edutrek LLC, doing business as Edutrek, and Does 1 through 10, alleging they illegally contacted the plaintiff's cellular telephone in an attempt to solicit their services.
According to the complaint, in April, Alan suffered damages the result of being contacted several times on his cellular telephone by the defendants.
The plaintiff alleges the defendants used an automatic telephone dialing system to contact the plaintiff's cellular phone without Alan's permission and even though Alan's name was on the National Do-Not Call Registry, violating the Telephone Consumer Protection Act.
Alan seeks trial by jury, statutory damages of $500, treble damages of $1,500, all legal fees and all other relief the court deems just. He is represented by attorneys Todd M. Friedman, Adrian R. Bacon and Meghan E. George of Law Offices of Todd M. Friedman, P.C. in Woodland Hills, California.
