LOS ANGELES (Legal Newsline) — A California man is suing a web optimization company, alleging he has received multiple unwanted phone calls.
Jonathan Weisberg of Whitter California, filed a class action complaint, individually and on behalf of all others similarly situated, Oct. 5 in U.S. District Court for the Central District of California against Local Top Rank and Does 1-10, alleging violation of the Telephone Consumer Protection Act, through intrusive and unwanted phone calls.
According to the complaint, Weisberg was by the defendants on his cellular telephone in attempts to solicit the plaintiff to purchase Local Top Rank services. More so, the suit says, these calls used an automatic telephone dialing system or an artificial or prerecorded voice.
The lawsuit states the calls were made without express consent from Weisberg, and some of the class' lines had been added to the National Do-Not-Call Registry. Consequently, the suit says, the plaintiffs were harmed as a result of the defendants' actions, including incoming call charges, invasion of privacy and unavailability of their phone lines for legitimate or emergency calls.
The plaintiff alleges the defendants failed to acquire express consent from recipients before engaging them in solicitations calls and ignored several demands to cease calls.
Weisberg seeks trial by jury, $500 in statutory damages, treble damages of $1,500 for every willful violation, and all other relief the court deems just. He is represented by attorneys Todd M.
