California consumer accuses GetVisibleWeb.com of unlawful solicitation

LOS ANGELES (Legal Newsline) — A California man is suing website platform owners, alleging violation of telephone harassment statutes.

Edward Makaron of Los Angeles County filed a class action lawsuit, individually and on behalf of all others similarly situated, Sept. 12 in U.S. District Court for the Central District of California against GetVisibleWeb.com, Vincent Baid, Ratan Baid, Vivek Baid and Does 1-10, alleging willful violation of the Telephone Consumer Protection Act.

According to the complaint, in April 2016, Makaron began receiving calls to his cellular telephone from the defendants to solicit their services. The suit says Makaron was caused to sustain incurring charges for incoming calls. 

The plaintiff holds alleges the defendants placed calls using an automatic telephone dialing system and/or an artificial or prerecorded voice without his prior express consent and were not for emergency purposes.

Makaron seeks trial by jury, injunctive relief prohibiting the defendants' conduct in the future, $500 in statutory damages and $1,500 in treble damages for each violation, plus all other relief deemed just and proper.
