Football fan accuses NFL of mismanagement in canceled game

LOS ANGELES (Legal Newsline) — A Los Angeles man is suing the National Football League and Pro Football Hall of Fame, alleging breach of contract in the canceling of the Hall of Fame exhibition game.

Greg Herrick filed a class action lawsuit, individually and on behalf of all others similarly situated, Aug. 23 in U.S. District Court for the Central District of California against the National Football League and National Football Museum Inc., doing business as the Pro Football Hall of Fame, alleging they breached their duty by failing to inform fans the game would be cancelled.

According to the complaint, Herrick suffered financial damages including out-of-pocket cost of tickets, lodging and travel expenses, costs associated with items purchased on the day of the game and missed hours and days of employment for certain fans who took vacation time to attend the scheduled Aug. 7 game in Canton, Ohio, between the Green Bay Packers and the Indianapolis Colts. 

The plaintiff alleges the defendants allegedly continued to maintain a facade of normality for fans and the general public, and allowed and encouraged fans to continue to purchase food, beverages and souvenirs. The game was never played due to an unplayable field.

Herrick seeks trial by jury, judgment for economic loss and damages, attorney fees, court costs, pre- and post-judgment interest and all other relief to which he is entitled. He is represented by attorney Michael J. Avenatti of Eagan Avenatti LLP in Newport Beach, California.
