MEMPHIS, Tenn. (Legal Newsline) – A Mississippi man alleges law offices in Arkansas and Memphis are charging him excessive and unreasonable fees.
Mitch Goree filed a complaint in the U.S. District Court for the Western District of Tennessee, Western Division against Sutter & Gillham PLLC and Andrew C. Clarke, doing business as the Law Office of Andrew C. Clarke, alleging that they failed to comply with the Tennessee Rules of Professional Conduct.
According to the complaint, the plaintiff contracted with Harrill & Sutter PLLC, which later associated with the defendants, to represent him in a discrimination case against United Parcel Service in 2010. The suit states a jury ruled in Goree's favor in 2014, and an appellate court affirmed the award in 2015.
The plaintiff holds Sutter & Gillham PLLC and Clarke responsible because the defendants allegedly retained possession of his check over claims that they are entitled to $959,399.16 in attorneys’ fees, an additional $400,000 in attorneys’ fees based upon a possible increase in his UPS pension and $188,736.57 in expenses.
The plaintiff requests a trial by jury and seeks judgment against defendants that attorneys’ fees and expenses they are charging are excessive and unreasonable, costs of this action, pre- and post-judgment interest, attorneys’ fees and such other relief as the court deems necessary and proper.
