LOS ANGELES — A California man is suing an insurance firm and others, alleging they sent him automated text messages without his consent.
Jonathan Payton filed a class action lawsuit, individually and on behalf all others similarly situated, June 9 in U.S. District Court for the Central District of California against Quotewhiz LLC, Policy Go LLC, Insuresquare LLC, Adam Weisntein, and Does 1-100, alleging violation of the Telephone Consumer Protection Act.
According to the complaint, on Feb. 4, Payton received a message from the defendants through an automatic telephone dialing system informing him that he's qualified for the 19/month auto insurance although he never contacted them before by any means. By receiving such messages, the plaintiff has incurred charges, the suit says.
The plaintiff alleges the defendants were not given consent by Payton to send automated and unsolicited messages.
Payton seeks a trial by jury, $500 to $1,500 in statutory damages for each violation, injunctive relief prohibiting such conduct in the future, and any other relief the court deems proper.
