New York City customer alleges Avis terms, conditions illegal

NEWARK, N.J. (Legal Newsline) - A New York City man is suing Avis, alleging its terms and conditions contain illegal provisions.

Joshua Schleifer, individually and for all others similarly situated, filed a class action lawsuit April 15 in U.S. District Court for the District of New Jersey against Avis Rent A Car System LLC and Avis Budget Group, alleging violations of New Jersey's Truth-in-Consumer Contract, Warranty and Notice Act.

The suit alleges the terms and conditions on the defendants' website, www.avis.com, contain provisions that illegally attempt to absolve themselves of all possible liability and obscure the effects of their disclaimers on New Jersey residents.

Schleifer and others in the class seek a jury trial, a judgment of at least $100 per violation for each class member, injunctive relief, attorney fees and costs. They are represented by attorney Fred M. Zemel of The Zemel Law Firm in Newark.
