PHILADELPHIA (Legal Newsline) - Two women are suing Kohl's, alleging it sent unauthorized text messages to their cellphones.

Lynne Winner of Pennsylvania and Destiny Jennings of Florida, individually and for all others similarly situated, filed a class action lawsuit April 4 in U.S. District Court for the Eastern District of Pennsylvania against Kohl's Department Stores, alleging violations of the Telephone Consumer Protection Act.

The suit alleges Kohl's used an automated system to send telemarketing text messages to consumers without their clear and conspicuous consent. The complaint states Kohl's also disregarded consumers' requests for the text messages to stop.

Winner, Jennings and others in the class seek a jury trial, injunctive and declaratory relief, statutory damages of $500 per violating call, treble damages of $1,500 per violating call, plus attorney fees and costs. They are represented by attorney Sergei Lemberg of Lemberg Law in Wilton, Connecticut.
