CAMDEN, New Jersey (Legal Newsline) - A New Jersey woman is suing Nissan, alleging it offers a service contract with unspecific provisions.

Roseann Romeo of Glendora, individually and for all others similarly situated, filed a class action lawsuit March 23 in U.S. District Court for the District of New Jersey Camden Vicinage against Nissan North America Inc., Nissan Extended Services North America G.P., and Nissan Extended Services North America Inc., alleging violations of the New Jersey Service Contract Act (SCA), violations of the Truth in Consumer Contract, Warranty and Notice Act (TCCWNA), and violations of the New Jersey Consumer Fraud Act (CFA).

The suit alleges Nissan offers, at the sale of a vehicle, a vehicle service contract (VSC).  The complaint states the defendants' VSC violates the SCA and CFA by failing to provide or properly disclose the conditions governing cancellation of the contract by the contract holder or the provider, among other violations.

The lawsuit states the Nissan contract violates the TCCWNA because it does not specify which provisions are enforceable in New Jersey.

Romeo and others in the class seek compensatory, treble, consequential, statutory, and/or punitive damages, plus declaratory and injunctive relief, interest, restitution and other equitable relief, attorney fees, costs of the suit and a jury trial.
