BMW sued over alleged engine reliability issues

LOS ANGELES (Legal Newsline) – A California resident is suing a vehicle manufacturer over claims a certain vehicle engine had reliability issues.

Gurdip Kelley, individually and for all others similarly situated, filed a class-action lawsuit Dec. 17 in the Central District of California against BMW of North America, alleging breach of express and implied warranties and violations of California business codes.

The suit claims BMW's 4.4-liter V8 version of the N63B4400 engine, manufactured between 2008 and 2013, has engine reliability issues that result from problems in the timing chain, fuel injectors, mass airflow sensors, crankcase vent lines, battery, the engine vacuum pump and low-pressure fuel sensor.

According to the suit, these issues led to more serious concerns, including excessive battery drainage, oil leakage and engine seizure, sometimes causing pistons to crack the engine block from high pressure.

The suit states issues may arise in the N63 engine regardless of mileage and have sometimes occurred in vehicles with fewer than 20,000 miles.

Kelley and others in the class seek actual and compensatory damages, restitution, interests, and attorney fees and costs, together to exceed $5 million. They are represented by attorneys Todd M.
