Suit claims unsolicited Hubbard House faxes are illegal

CHICAGO (Legal Newsline) – A certain Chicago restaurant is being sued over claims of sending unsolicited fax advertisements.

American Legal Forms, on behalf of the plaintiff and the class members, filed a class action lawsuit Nov. 24 in the U.S. District Court for the Northern District of Illinois, Eastern Division against The Hubbard House Restaurant and John Does 1-10, alleging violations of the Telephone Consumer Protection Act.

On Oct. 13, the suit states, American Legal Forms received an unsolicited fax advertisement from Hubbard House as part of a mass broadcasting of faxes.

American Legal Forms had no prior relationship with the defendant and did not authorize the sending of fax advertisements, and the fax did not contain an opt-out notice, the suit states.

As a result, the plaintiff and at least 40 other persons in Illinois suffered damages in the form of paper and ink or toner consumed, and violation of privacy.

The plaintiff and others in the class seek actual and statutory damages, an injunction against the further transmission of unsolicited fax advertising, and costs of the suit. The plaintiff is represented by attorneys Daniel A. Edelman, Cathleen M. Combs, James O. Latturner, and Dulijaza Clark of Edelman Combs Latturner & Goodwin in Chicago.
