KANSAS CITY, Mo. (Legal Newsline) -- Two Missouri consumers have sued a Kansas City auto dealer for allegedly selling hail-damaged cars without disclosing that repairs had been done on the vehicles. 

Samantha Garner and Stephanie Chasten filed a class-action lawsuit in the Circuit Court of Jackson County in Missouri in September against Kansas City Auto Acquisitions, Inc.; Greenway Automotive, Inc.; and Greenway Automotive Ventures, LLC for allegedly violating the Missouri Merchandising Practices Act.

The case has since been removed to federal court.

Garner and Chastain allege that the defendants engaged in a deceptive and unfair scheme to sell hail-damaged vehicles to unsuspecting consumers.

Kansas City Auto and Greenway allegedly hired one or more outside companies to perform paintless dent repair services on hail-damaged vehicles instead of reporting insurance claims to their own insurance company, which would have been more costly and would have been disclosed to independent reporting agencies.

The companies allegedly concealed, omitted, suppressed or failed to reveal that the vehicles were hail-damaged to a number of consumers. Those consumers included Garner, who purchased a 2014 Chrysler 300 on Nov. 3, 2014, and Chasten, who purchased a 2014 Jeep Wrangler on  Oct.  17, 2014. 

Chasten and Garner are suing for an undisclosed amount of punitive damages, an injunction to stop the defendants from further unlawful acts, attorney and court costs, and any other rewards deemed just by the court. They are represented by Chad C. Beaver from Beaver Law Firm, LLC and Lewis M. Galloway from LG Law, LLC in Kansas City.
