Sears Holdings Corp. is being sued in California court for allegedly charging an installation fee for an HVAC system and never performing the work.
Edwin Ruano filed the lawsuit Aug. 10 in California Superior Court against Sears over issues with an HVAC system.
The lawsuit said the company charges $195 as an “installation analysis” that is for the installer to “assess the equipment that will be needed to complete the HVAC installation on the installation date.”
“However, the installation analysis is never performed by Sears or its designated installers,” the lawsuit said. “Rather, Sears and the designated installer simply pocket the money with no such Installation analysis ever being performed.”
Additionally, the lawsuit claims the company charges $100 per light to install UV lights in the plenum or evaporator coil, but that work is never completed either.
The lawsuit seeks class status for those who purchased HVAC systems in California over the last four years. Ruano is also seeking an unspecified amount in damages.
The plaintiffs are represented by Brian S. Kabateck, Terry R. Bailey of Kabateck Brown Kellner LLP in Los Angeles and Maryam Parman and Melody Parman of Avrek Law Firm in Irvine.
