INDIANAPOLIS (Legal Newsline) - A manufacturer of air conditioners and heat pumps is facing a lawsuit that claims the copper coils in the company's products are defective.
Andrea Brandes Newsom filed the lawsuit in United States District Court in Indiana against Goodman Manufacturing Company alleging the copper coils prematurely corrode and develop holes and cracks.
The lawsuit said the coils can't stand the higher pressure of the environmentally-friendly refrigerant that is required to be used under Indiana state law. The suit said the refrigerant leaks from the air conditioning system or heat pump, and having a lower level of refrigerant causes the coil to freeze.
According to the suit, Goodman hasn't disclosed the defective coils to the public, and the damage caused by the coils can reach several thousand dollars. The problem also causes higher utility bills, the lawsuit said.
Newsom is seeking class status for those who purchased the defective products from Goodman. She is also seeking more than $5 million in damages plus court costs.
She is represented by Irwin B. Levin, Richard E. Shevitz, Vess A. Miller and Lynn A. Toops of Cohen & Malad, LLP in Indianapolis.
