Mass. cites Deerfield company for prevailing wage violations‏

BOSTON (Legal Newsline) - A Deerfield, N.H., electrical company has been cited by Attorney General Martha Coakley's office for violating the Massachusetts Prevailing Wage Law.

Ewing Electrical Company Inc., and Philip E. Davidson, its owner, will pay $37,300 in restitution to their workers as a result of the citation and an additional $2,000 fine will be paid to the commonwealth.

An investigation into Ewing Electrical Company by the attorney general's Fair Labor Division began in June 2008 following a complaint that alleged the company had improperly submitted certified Payroll Records, which are required under the Massachusetts Prevailing Wage Laws.

Through the course of the investigation, it was revealed that Ewing Electrical company had improperly paid the prevailing wage rate, which is required on public projects in the commonwealth, from January 2006 through January 2009. A subsequent audit revealed that more than $37,000 had been failed to be paid to 18 employees over that time period.

Massachusetts' Prevailing Wage Law requires that any employers working on public works projects int he commonwealth pay the prevailing wage, which is a set minimum hourly wage for labor performed at public construction sites, and submit Certified Payroll Records on a weekly basis to the appropriate awarding authority.

The submitted records must indicated the classification of the employee, hourly rate of pay and amount of allowable fringe benefits.
