JEFFERSON CITY, Mo. (Legal Newsline) - Missouri Attorney General Chris Koster announced on Tuesday that he has filed a lawsuit and obtained a temporary restraining order against a telemarketing company that allegedly violated the state's No-Call List Act.
The action was taken against Travellink Corp., Travel and Vacation Marketing Services Inc., and Okie Miller, also known as Olen Miller Inc., which are all based in Tampa, Fla.
Koster alleges that the telemarketers made solicitation calls to Missourians who previously had placed their names on the state's no-call list.
He also alleges that the telemarketing company violated the state's Merchandising Practices Act by making repetitive and harassing calls to consumers informing them of prizes they had won and soliciting vacation travel packages from them.
"When Missourians register with our No-Call list, they do so with the reasonable expectation that they will not receive these unsolicited, harassing calls," Koster said. "These businesses are aware of our No-Call laws, and they are realizing that this office will enforce those laws."
Koster is seeking a court order for a permanent injunction against the defendants to stop them from making future calls to those in his state who have registered for the no-call list and don't have any established business relationship with the company. He also wants a $5,000 civil penalty for each violation of Missouri law, as well as all costs associated with the litigation.
