HARRISBURG, Pa. (Legal Newsline) - Pennsylvania Attorney General Kathleen Kane announced Tuesday her office has obtained a preliminary injunction a New Oxford hearing aid fitter who allegedly continued to operate with a suspended license.
Timothy Rooney was a registered hearing aid fitter in Pennsylvania with offices in New Oxford and Hanover, as well as an office at his New Oxford residence.
Rooney operated under the names American Hearing Aid Centers Inc. and American Hearing Aid Centers. He also called on consumers at senior care facilities and their homes.
The Pennsylvania Department of Health suspended Rooney's registration for five years in August following an inquiry into multiple consumer complaints. His registration then was revoked for allegedly violating the five-year suspension agreement.
Kane's office received additional complaints about Rooney after he allegedly continued to operate as a hearing aid fitter without a valid license. The preliminary injunction prohibits Rooney from the sale, fitting or adjustment of hearing aids.
An advisory in March that was submitted by Kane's office warned consumers about Rooney and asked them to contact the office if they had any business dealings with Rooney since Aug. 21, 2013.
Kane's office reminded consumers that when buying a hearing aid, state law requires that hearing aid fitters provide consumers with a written disclosure agreement with itemized fees, a receipt and a 30-day guarantee.
