MONTGOMERY, Ala. (Legal Newsline) -- Alabama Attorney General Luther Strange announced Thursday a final order against SWATS Edge Performance Chips LLC to grant permanent injunctive relief against the sports performance company.
Jefferson County Circuit Court Judge Caryl Privett issued a court order Thursday permanently enjoining SWATS and its principal officers, Christopher Key and Mitchell Ross, from doing business in the state of Alabama or with Alabama consumers.
The Birmingham-area SWATS and its officers allegedly engaged in 263 violations of the Alabama Trade Practices Act related to unsupported and dangerous health claims.
Privett also made permanent the prior appointment of a receiver to safeguard the remaining assets of SWATS and to deal with consumer claims against the company.
"I am very pleased by the court's decision to issue a final order for the protection of Alabama's consumers," Strange said in a statement. "The extreme and even absurd nature of health claims made by this company could be harmful to those who might rely on these products and believe their health needs were being met. But even more worrisome were the potential dangers from some of the products themselves.
"Our action and the judge's order should serve as a warning that we will not allow companies to defraud and endanger the consumers of Alabama."
Strange filed a lawsuit against SWATS in September. SWATS allegedly sold mislabeled, misleading and dangerous products to the public, including a cooling concussion cap, tablets that purportedly contained insulin-like growth factor and pain management chips.
