Wisconsin AG reaches $27,500 agreement with animal rendering facility

MADISON, Wis. (Legal Newsline) - Wisconsin Attorney General J.B. Van Hollen announced a judgment and order against a Medina-based animal rendering facility that allegedly violated a permit issued by the Wisconsin Department of Natural Resources (DNR).

Van Hollen's office filed a lawsuit in Dane County Circuit Court alleging that Bailey Farms LLC allegedly violated its pollutant discharge system elimination permit. The facility discharges wastewater pollutants within the Upper Rock River drainage basin under the authority of the permit.

The lawsuit alleged Bailey violated its permit by discharging pollutants without a permit, failing to submit required reports, over-applying chlorides and nitrogen to a site approved for spreading pollutants and failing to notify the DNR of a discharge. Bailey also allegedly failed to prevent ponding, failed to properly dispose of septage, failed to monitor its discharges to land spreading systems, engaged in land spreading in unapproved areas and built an unapproved storage structure.

Van Hollen's lawsuit sought an injunction requiring Bailey to comply with state law, forfeitures and the payment of attorney costs.

Bailey agreed to pay $27,500 in forfeitures and penalties to resolve the allegations. The animal rendering facility also agreed to change its operation to bring the facility into complete compliance with its permit and state laws.
